MatchMusic – Terms and Conditions

Welcome to MatchMusic (“we,” “our company,” or “the platform”). By registering and using our services, you agree to comply with these Terms and Conditions. If you do not agree with any part of these terms, do not use our platform.

1. Company Information

MatchMusic is a company registered in the United States. The platform operates as a digital marketplace connecting artists and playlist curators, allowing song submissions in exchange for internal credits. The platform acts as an intermediary and does not guarantee playlist placement or commercial results.

2. Minimum Age and Parental Consent

  • Users must be at least 16 years old to register and use the platform.
  • Users under 18 must have explicit consent from a parent or legal guardian, especially for financial transactions.

3. User Registration and Accounts

  • Users can register as either artists or curators.
  • Curators provide the following information: full name, email, Spotify account details, private tokens associated with their curator profile, and banking information for payments. All data is stored securely.
  • Artists provide their name, email, and information associated with their songs and public profile.
  • Curators are external collaborators, not employees of the platform.
  • Each user is responsible for maintaining the confidentiality of their account credentials and for all actions performed through their account.

4. Credits and Payments

  • Credits are internal virtual currency, equivalent to one U.S. dollar, with no value outside the platform.
  • Credits do not expire and are non-refundable, except in exceptional cases where the user may choose to receive either a real money refund or credits within the platform.
  • Minimum spend for artists: $5.
  • Minimum withdrawal for curators: $20.
  • All payments are processed via Stripe, ensuring industry-standard security.
  • Payments are processed within up to 20 business days.
  • Users acknowledge that MatchMusic is not responsible for converting credits to real money outside the platform.

5. Platform Use and User Obligations

  • Curators must listen to and review each submitted song, providing detailed technical feedback covering mix, master, structure, originality, and overall sound.
  • Each track must be listened to for a minimum duration before submitting feedback. Skipping tracks is not allowed.
  • Artists and curators must act in good faith. Any inappropriate or offensive feedback, or violations of platform rules, may result in suspension or account termination.
  • Curators may not use submitted music outside the platform, and artists must submit only content they own or have rights to.
  • The platform does not guarantee playlist placement or commercial outcomes.

6. Service Interruptions

  • MatchMusic may experience technical interruptions or server outages.
  • If technical issues prevent completing feedback within 72 hours, the review period will be automatically extended to ensure all submissions are processed.
  • MatchMusic is not responsible for any financial losses arising from service interruptions, technical issues, or platform use.

7. Account Deletion

  • Users can delete their accounts at any time through profile settings or by contacting support.
  • Deleting an account results in immediate loss of all associated credits, except in exceptional cases validated by support.
  • Reopening old accounts or transferring credits is evaluated on a case-by-case basis, at the platform’s discretion.

8. Intellectual Property and Copyright

  • The platform does not acquire rights to submitted music.
  • Curators may not use music outside the platform.
  • Submitted songs must be owned by the user or properly licensed.
  • Copyright violations or misuse will be handled as follows:
    • Immediate removal of the track.
    • Suspension or termination of the infringing account.

9. Liability and Limitation of Damages

  • MatchMusic is not responsible for financial losses, reputational harm, or contractual outcomes of users.
  • The platform provides limited liability for service interruptions and ensures feedback extension in case of technical failures.

10. Modifications to Terms

  • MatchMusic reserves the right to modify these Terms at any time.
  • Updates will be communicated via email and in-platform notifications.
  • Continued use of the platform constitutes acceptance of the updated Terms.

11. Promotional Emails

  • Users may receive promotional emails only through opt-in, in compliance with GDPR/European Union regulations.
  • Users can withdraw consent at any time using the unsubscribe link in each email.

12. Governing Law and Jurisdiction

These Terms are governed by the laws of the United States. Any disputes will be resolved under U.S. jurisdiction.
